These terms govern your use of the personal AI assistant SMS service operated by Jimmy Schaffer (the "operator") at gandalf-studio.work. The service consists of three persona-specific bot agents — Evelyn, Gandalf, and Merlin — running on a personal Mac Studio and communicating via SMS with a small allowlist of pre-approved personal contacts.

Eligibility

The service is available only to recipients explicitly added to the operator's allowlist by prior arrangement. Messages from non-allowlisted phone numbers are ignored automatically. There is no public sign-up. By being added to the allowlist, you agree that your inclusion is voluntary and based on prior personal agreement with the operator.

Nature of the service

• The service is personal, conversational, and non-commercial.
• Replies are generated by AI agents (using Anthropic's Claude API). Responses are based on the agents' configured contexts and may be inaccurate, incomplete, or outdated. Treat replies as informational, not authoritative.
• The agents do not provide professional advice (legal, financial, medical, etc.) even when responding to questions in those areas.

Acceptable use

You agree not to:

• Send messages intended to abuse, harass, or extract sensitive information from the agents or their operator
• Attempt to manipulate the AI agents into producing harmful or unlawful content
• Forward conversations to third parties without the operator's consent
• Use the service for any purpose other than personal conversation

Operator rights

The operator reserves the right to:

• Modify, suspend, or terminate the service at any time, with or without notice
• Remove any contact from the allowlist at any time, with or without reason
• Update these terms; continued use after updates constitutes acceptance
• Retain conversation logs for service operation and quality review (see Privacy Policy)

Opt-out

You may opt out at any time by:

• Replying STOP to any bot number (Twilio's carrier-level handling halts further messages automatically)
• Or contacting the operator directly to be removed from the allowlist

No warranty

The service is provided "as is" without warranties of any kind, express or implied. The operator does not guarantee uptime, accuracy, deliverability, or availability of any persona at any given time. SMS delivery is subject to carrier filtering and third-party (Twilio) service availability.

Limitation of liability

The operator is not liable for any direct, indirect, incidental, or consequential damages arising from use of the service, including but not limited to: reliance on agent responses, missed messages, delayed deliveries, or unauthorized access. The operator's maximum aggregate liability for any claim related to the service is limited to zero dollars (USD $0), reflecting the non-commercial personal nature of the service.

The service depends on third-party platforms whose terms also apply to the relevant aspects of your use:

Governing law

These terms are governed by the laws of the United States and the operator's state of residence, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
